Do I Need Title Insurance?

Most definitely! Title insurance is a means of protecting yourself from financial loss in the event that problems develop regarding the rights to ownership of your property. There may be hidden title defects that even the most careful title search may not reveal. In addition to protection from financial loss, title insurance pays the cost of defending against any covered claim.

The Lender Already Requires Title Insurance. Will That Protect Me?

Not necessarily. There are two types of Title insurance. Your lender likely will require that you purchase a lender's policy. This policy only insures that the financial institution has a valid, enforceable lien on the property. Most lenders require this type of insurance and typically require the borrower to pay for it.

What Items Are Needed At Closing?

The Seller Will Need:

  • Photo identification (state issued driver's license or identification card, military identification or passport).

  • Any unrecorded instruments that affect the title.

  • Proof of satisfaction of any judgments, mechanic's lien, or mortgages paid prior to the closing.

  • Invoices of any unpaid taxes.

The Buyer Will Need:

  • Cashier’s check for balance due at the time of closing. (Your title agent, realtor or lender will contact you with that final amount).

  • Proof of purchase on homeowners insurance along with a paid receipt.

  • Photo identification (state issued driver’s license or identification card, military identification or passport).



 

What is Title Insurance?

The primary purpose of title insurance is to eliminate risks and prevent losses caused by defects in title arising from events that have happened in the past. To achieve this goal, title insurers perform an extensive search of the public records to determine whether there are any adverse claims to the subject real estate. Those claims are either eliminated prior to the issuance of a title policy or their existence is excepted from coverage.
